Website Service Agreement

1. The Service (What You Get)

We provide a "Done-For-You" website service for $79/month. This includes:

• Initial Build: A 5-10 page mobile-responsive website based on our templates.
• Hosting & Maintenance: Secure hosting, SSL certificate, daily backups, and security updates.
• Ongoing Support: Standard text/image edits and technical support (Mon-Fri, 9am-5pm PT).
• Annual Health Check: A yearly review of your site's accessibility and performance.
• Everfresh Guarantee: A complimentary design refresh every 36 months of active service.

What's NOT Included: E-commerce, custom coding/app development, logo design, full copywriting, or advanced SEO campaigns.

2. Payments & Pricing

• Introductory Rate: $39 for the first 6 months (or sooner if the client chooses to), after that the rate becomes $79.00/month, charged automatically.
• Founding Members: For the first 100 clients, this rate is locked for life unless our hard infrastructure costs (hosting/servers) rise by more than 30%.
• Cancellation: You may cancel anytime. We require 30 days' written notice (email is fine).
• Money-Back Guarantee: If you cancel within the first 60 days, we will refund your first month's payment.
• Late Fees: A $25 fee applies if payments are 14+ days late. Service may be suspended after 14 days of non-payment.

3. Unlimited Edits & "Fair Use"

We offer unlimited standard edits to keep your site current.

• Scope: Includes changing text, swapping images, adding new pages using our standard templates (up to a 35-page site limit), and minor layout tweaks.
• Fair Use: To keep our prices low, we ask that requests generally take under 45 minutes to complete. If a request is too complex (e.g., a total site redesign outside the Everfresh cycle), we will quote it as a separate project at $125/hour.
• Turnaround: We aim to complete standard edits within 1-3 business days.

4. Content & Ownership (Who Owns What)

• Your Content: You own all text, images, and data you provide. You represent that you have the legal right to use them.
• Our Tech: We own the templates, code structure, and design systems used to build the site.
• If You Leave: Upon cancellation-and upon your request-we will provide you with an Export Package (HTML/CSS/JS/Images) so you can host the site elsewhere. You own the finished "static" site, but you will not receive our internal build tools or backend systems.

5. Client Responsibilities

• Content: You must provide the text and images for your site.
• Legality: You agree not to use the site for illegal activity, spam, or hate speech.
• No HIPAA Data: You agree not to collect Protected Health Information (medical records) through our contact forms, as we are not a HIPAA-compliant entity.

6. Warranties & Disclaimers

• "As Is" Service: We promise to build your site professionally and securely. However, we do not guarantee specific SEO rankings, business results, or 100% uptime (though we aim for 99.5%).
• Accessibility: We build using WCAG 2.1 AA best practices, but we do not guarantee full legal compliance with the ADA, as standards evolve constantly.

7. Limitation of Liability

To the maximum extent permitted by law, Uzunu's liability for any claims related to this service is limited to the total amount you paid us in the last 12 months. We are not liable for lost profits, data loss, or indirect damages.

8. General Terms

• Governing Law: This agreement is governed by the laws of California (San Luis Obispo County).
• Modifications: We may update our operational policies (like Fair Use) with 30 days' notice.
• Entire Agreement: This document replaces all prior discussions.
