1. The Service: what you get
We provide a Website Service for $99/month. This includes:
- Initial Build: A 5-10 page mobile-friendly website based on the agreed design direction for your business.
- Hosting & Technical Care: Secure hosting, SSL certificate, daily backups, and security fixes needed to keep the site healthy.
- Website Changes and support: Standard text and image changes, plus technical support, Monday through Friday, 9am-5pm Pacific.
- Annual Health Check: A yearly review of your site's accessibility and performance.
- Design refresh: A complimentary design refresh every 36 months of active service.
What is not included: e-commerce, custom coding or app development, logo design, full copywriting, or advanced SEO campaigns.
2. Payments and pricing
- Monthly Rate: $99/month, charged automatically. If a separate signed order form or written agreement gives a different grandfathered rate, that written client-specific agreement controls.
- Cancellation: You may cancel anytime. We require 30 days' written notice; email is fine.
- First 60 days: If you cancel within the first 60 days, we will refund your first month's payment.
- Late Fees: A $25 fee applies if payments are 14 or more days late. Service may be suspended after 14 days of non-payment.
3. Website Changes and fair use
Website Changes are part of the service so your site can keep up when the business changes.
- Scope: Includes changing text, swapping images, adding new pages using our standard site structures up to a 35-page site limit, and minor layout tweaks.
- Fair Use: To keep the service sustainable, requests should generally take under 45 minutes to complete. If a request is too complex, such as a total site redesign outside the 36-month design refresh cycle, we will quote it as a separate project at $125/hour.
- Turnaround: We aim to complete standard changes within 1-3 business days.
4. Content and ownership: who owns what
- Your Content: You own all text, images, and data you provide. You represent that you have the legal right to use them.
- YouGrow's internal tools: We keep ownership of our internal build tools, reusable code, templates, design systems, automation, and hosting setup.
- If You Leave: Upon cancellation, and upon your request, we will provide you with an Export Package of HTML, CSS, JavaScript, and images so you can host the site elsewhere. You own the finished static site, but you will not receive our internal build tools or backend systems.
5. Client responsibilities
- Content: You must provide the text and images needed for your site.
- Legality: You agree not to use the site for illegal activity, spam, or hate speech.
- No Protected Health Information: You agree not to collect Protected Health Information, including medical records, through our contact forms because we are not a HIPAA-compliant entity.
6. Warranties and disclaimers
- As-Is Service: We promise to build your site professionally and securely. However, we do not guarantee specific SEO rankings, business results, or 100% uptime, though we aim for 99.5%.
- Accessibility: We build using recognized accessibility best practices, but we do not guarantee full legal compliance with the ADA because standards evolve constantly.
7. Limitation of Liability
To the maximum extent permitted by law, Uzunu's liability for any claims related to this service is limited to the total amount you paid us in the last 12 months. We are not liable for lost profits, data loss, or indirect damages.
8. General terms
- Governing Law: This agreement is governed by the laws of California, San Luis Obispo County.
- Modifications: We may update our operational policies, including fair use, with 30 days' notice.
- Entire Agreement: This document replaces all prior discussions unless a signed order form or written client-specific agreement says otherwise.
